Global Data and Consulting Solutions, LLC ("GDACS", "we", "us") publishes the IQ Dominoes mobile application ("the App"). These Terms of Service ("Terms") govern your use of the App. Please read them carefully.
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please stop using the App and uninstall it from your device.
You must be at least 13 years old to use the App. If you are between 13 and 17, you confirm that a parent or legal guardian has reviewed these Terms and approved your use of the App. We do not knowingly collect data from anyone under 13. If we learn that someone under 13 has used the App, we will remove their data.
The App does not require you to register an account. Instead, you choose a display name that appears to other players during multiplayer matches. Your display name is user-generated content visible to other players. The following rules apply:
We may reject, change, or require you to change a display name that violates these rules.
While using the App, you agree not to:
We may suspend or terminate your access to the App for any violation of these rules, with or without notice.
The App provides in-app affordances to report or block other players. If another player's display name or behavior violates these Terms, please use the in-app Report or Block options. We review reports and may take action at our discretion, including warnings, name changes, temporary suspensions, or permanent removal from the multiplayer service. Blocking a player prevents them from being matched with you in future games.
You retain ownership of your display name and any other content you submit through the App. By submitting content, you grant GDACS a non-exclusive, worldwide, royalty-free license to display, transmit, and store that content solely for the purpose of providing the App's multiplayer functionality (showing your display name to other players in a match, persisting it briefly on our server while a match is active, etc.). This license ends when you stop using the App, except to the extent we need to retain content for the purposes described in our Privacy Policy.
The App's multiplayer service is provided as-is and subject to availability. We may modify, suspend, or discontinue features, game modes, or the service as a whole at any time, with or without notice. We may also perform maintenance that temporarily interrupts service. We are not responsible for any inability to access or use the App during such periods.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
TO THE FULLEST EXTENT PERMITTED BY LAW, GDACS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY U.S. DOLLARS ($50). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THIS LIMITATION MAY NOT APPLY TO YOU.
You agree to indemnify and hold harmless GDACS, its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your violation of these Terms or your misuse of the App.
You may stop using the App at any time by uninstalling it from your device. We may terminate or suspend your access to the App at any time if you violate these Terms or if we discontinue the service. Sections 6 (the license you grant us, for content already submitted), 8 (No Warranty), 9 (Limitation of Liability), 10 (Indemnification), and 12 (Governing Law) will survive termination.
These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the App will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the jurisdiction of those courts.
We may update these Terms from time to time. If we make material changes, we will announce them in the App and update the effective date above. Continued use of the App after changes take effect means you accept the updated Terms. If you do not accept the changes, please stop using the App.
